BumpySkies is a turbulence forecast service operated by Jason McIntosh ("the Operator") in New York. By using the BumpySkies website or any of its features, you agree to these terms. If you do not agree, please do not use BumpySkies.
BumpySkies offers free turbulence forecasts for commercial flights within the continental United States, generated from public weather and flight data. BumpySkies also offers an optional Premium tier that adds notification features for a small monthly subscription fee. Some features may change or be added or removed over time.
BumpySkies is provided "as is," without warranty of any kind. Turbulence forecasts are generated automatically from public data sources and are intended for general informational and educational use only. Forecasts may be incomplete, delayed, or wrong, and actual flight conditions may differ significantly from any forecast BumpySkies publishes.
Do not use BumpySkies forecasts as the basis for any safety-critical decision. BumpySkies is not a substitute for the judgment of pilots, dispatchers, air traffic controllers, or official aviation weather products, and nothing on the site should be treated as aviation guidance. Always follow the instructions of your flight crew.
You agree to use BumpySkies only for lawful purposes and in a way that does not interfere with anyone else's use of the service. In particular, you agree not to:
Creating a BumpySkies Premium account requires a valid email address. You are responsible for keeping your sign-in email secure and for any activity that takes place through your account. Don't share your magic-link sign-in emails with anyone you don't intend to give account access to.
Premium subscriptions are billed monthly in advance through Stripe. You can cancel your subscription from your account page at any time; cancellation takes effect at the end of the current billing period, and BumpySkies does not offer pro-rated refunds for partial months. The Operator may change subscription pricing or features with reasonable advance notice; if you don't agree to a pricing change, you can cancel before it takes effect.
The Operator may suspend or terminate any account that violates these terms or that the Operator has a good-faith reason to believe is being used abusively. If the Operator terminates an account for cause, no refund is owed.
If you opt in on your account page and provide a mobile phone number, BumpySkies may send you automated text messages related to your account's pending flight notifications, such as alerts that a turbulence forecast is ready for a flight you've asked to be notified about, plus occasional account-related status messages. BumpySkies does not send marketing or promotional text messages.
Message frequency varies. Message and data rates may apply. To stop receiving text messages, reply STOP to any BumpySkies message. For help, reply HELP, or email jmac@bumpyskies.com. SMS-related data is handled as described in the privacy policy.
The BumpySkies name, site design, and original written and graphical content belong to the Operator. The underlying weather and flight data come from public U.S. government sources (primarily the FAA and NOAA) and are not subject to copyright by BumpySkies. You may share links to BumpySkies pages and forecast images freely. Please don't copy the site's design or branding to make a competing or look-alike service.
To the fullest extent permitted by law, neither the Operator nor BumpySkies will be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of (or inability to use) the service. The Operator's total liability for any claim arising out of or relating to the service is limited to the greater of (a) the amount you paid BumpySkies in the twelve months before the claim arose, or (b) US$50.
Some jurisdictions don't allow certain liability limits, so parts of this section may not apply to you.
You agree to defend and hold harmless the Operator and BumpySkies from any third-party claims arising out of your misuse of the service or your violation of these terms.
The Operator may update these terms from time to time. When that happens, BumpySkies will update the "last updated" date at the top of this page, and material changes affecting Premium subscribers will be announced by email. Continuing to use the service after changes take effect means you accept the updated terms.
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts.
